Bill prohibiting distribution of fake news pulled from committee hearing

Assemblyman Ed Chau (D-Alhambra), chairman of the Assembly Privacy Committee and author of legislation that would severely hamper the ability of newspapers to cover political news stories, decided to postpone the hearing on the bill after receiving strong opposition from CNPA, the ACLU and the Electronic Frontier Foundation.

AB 1104 was introduced to deal with the problem of fake news and would make it unlawful for a person to knowingly and willingly make, publish or circulate on a website, a false or deceptive statement designed to influence the vote on any issue submitted to voters at an election or on any candidate for election to public office.

According to Chau’s staff, the author wants to sit down with the groups to see if there is a way to deal with the problem of fake news without affecting the First Amendment rights of individuals and newspapers.
